WORKER'S COMPENSATION AND INSURANCE
 
 

This information is intended to assist you in recognizing the importance of having appropriate protection relative to your employment of ICCP camp staff who may, in the course of events, either sustain an injury or otherwise require extensive hospitalization and health care beyond the limits common to health and accident insurance policies.

Having reviewed the matter with legal counsel, we strongly urge you to make certain that each member of your staff is covered by worker's compensation insurance and liability insurance as well.  Here are the points made by counsel:

1.         Workers compensation is designed to provide protection to the employee and employer.  Each state has a Worker's Compensation Commission with regulations by statute.

2.         Worker's compensation insurance is preferable to liability litigation in the event of accident of injury.

3.         All staff members whether on regular payroll, stipend, or room and board, should be included by your Worker's Compensation policy underwriter.  This includes international camp staff.

4.         For your protection, we recommend that:

            a.         You prepare two copies of your regular employee agreement, one to be signed and returned to you by your ICCP participant and the other signed copy to be retained by the employee.

            b.         In the agreement, the compensation and all of the provisions that constitute the arrangements you have made, including transportation, insurance, and any other aspects that enter into the employer-employee relationship.

5.         Each camp engaged with ICCP must carry general liability insurance coverage.  It is desirable to make known to employees that this is, in fact, the case.

Finally, we stand ready to assist to whatever extent possible in helping you and any ICCP participant have the best sort of contracted arrangement.  However, it must be made clear to each employee that he or she is engaged by the camp with which the contract is undertaken and that ICCP serves essentially as a service to assist camps and participants to become aware of each party's interests.
